California employers are required during an employee’s tenure with the company to provide employees with specific written notice of their rights. California has now updated two mandatory employee notice documents, as detailed below. You will want to be sure you are providing this notice as required, and using the latest version.
Updates to the EDD’s “For Your Benefit” Pamphlet
The California Employment Development Department (“EDD”) has updated its “For Your Benefit” pamphlet. This document must be given to employees at hire and discharge. The pamphlet outlines state benefits available upon termination or during certain leaves of absence, includes how to apply for unemployment insurance, details tax requirements for unemployment benefits, and lists who is ineligible for unemployment benefits, along with information on eligibility for state disability insurance. This pamphlet is available in Spanish.
Updates to the DIR “Time of Hire” Notice
The California Department of Industrial Relations Division of Workers Compensation (“DIR”) updated its “Time of Hire” notice. This document provides employees with an understanding of their workers’ compensation entitlements, including how to file a claim, how to access medical care, information on the injured employee’s right to consult with an attorney and that the employee’s attorneys’ fees can be deducted from the injured worker’s award. Employers are required to provide this to all new employees. This pamphlet also is available in Spanish.

Be sure that you meeting your notice obligations by providing these pamphlets, and be sure you are using the latest versions (not just what you’ve long-since had in your files).
